PRODUCT INFORMATION

The descriptions of the products displayed on the Website are made based on the information provided by the suppliers of THE COMPANY. However, the information given on each product, as well as the photographs or videos relating to them and the trade names, brands or distinctive signs of any kind contained on the website of THE COMPANY, are displayed on the Site as a guide, being able to contain some difference or error with the real product.

 

PRICES

The prices shown will include VAT or not depending on:

1) Client without registering or registered through the web as a private individual. Prices VAT included.

2) Registered customer, high processed by THE COMPANY. Prices VAT not included.

These prices do not include the expenses corresponding to the shipment of the products, which are detailed separately and must be accepted by the Client.

Other taxes, royalties or other similar ones in force or of new creation, state, autonomous or local, are borne by the buyer.

The company reserves the right to modify prices without prior notice.

 

AVAILABILITY

The COMPANY informs the Client that the number of available units is kept updated with the stock. PAYMENT

Credit cards accepted will be VISA and MASTERCARD.

At the initial price shown on the website for each of the products offered, the corresponding fees will be added to the relevant shipping costs. In any case, said rates will be previously communicated to the Client before formalizing the purchase itself.

The payment method will be by credit card; except for customers who have agreed to expressly another method, in which case it will be as expressly agreed. In case the form of payment is a transfer, the material will be sent when THE COMPANY has the money at its disposal. The User agrees to make lawful and appropriate use of this Website as well as the services provided by the company in accordance with this Legal Notice and not to develop activities contrary to law, morals, public order and in general, to make good use of these conditions.

BY-CITY MOTO, S.L. reserves, in case it carries out any activity contrary to the laws, the right to cancel the orders of any User or to deny access to the Website, without prior notice, and to exercise the legal actions it deems appropriate.

In the same way, the company guarantees that the server where the personal data are stored and processed, has the security measures of a technical and organizational nature necessary to avoid, as far as possible, the alteration, loss and / or access not authorized to the aforementioned personal data.

 

FORMALIZATION OF ORDERS

Once the order has been formalized, that is, with the acceptance of the Sales Conditions and the confirmation of the purchase process, THE COMPANY will always send an email to the CLIENT confirming the details of the purchase made.

 

CANCELLATION OR MODIFICATION OF ORDERS

THE COMPANY will accept cancellations and / or modifications of orders when they are requested before sending it. To make them, you must send an e-mail to info@bycity.es

However, the company does not guarantee to be able to carry out these changes if the order is already in its final preparation phase, so please be notified as soon as possible.

 

DEADLINES, PLACE OF DELIVERY AND LOSS

 

  1. Product delivery

THE COMPANY undertakes to deliver the product in perfect condition to the address indicated by the Client in the registration form or other indicated in the order, and which in any case must be included within the Territory.

THE COMPANY will not be responsible for the errors caused in the delivery when the delivery address is not adjusted to reality or has been omitted.

THE COMPANY informs the Customer that it is possible that the same order is divided into several deliveries.

 

  1. Delivery term

Shipments will be made through a courier company. The order placed by you will be delivered within a maximum period of 10 working days from when we have confirmed the order and once the payment has been confirmed.

These deadlines are means, and therefore an estimate. Therefore, they may vary due to logistical reasons or force majeure. In cases of delays in deliveries, THE COMPANY will inform its customers as soon as it becomes aware of them.

Each delivery is considered carried out from the moment in which the transport company puts the product at the disposal of the Customer, which is materialized through the control system used by the transport company.

In the case of delays in the delivery of the orders attributable to THE COMPANY, the Customer may cancel his order in accordance with the procedure described in Section “11. Return”. Delays in delivery will not be considered those cases in which the order has been made available to the Customer by the transport company within the agreed period and could not be delivered due to causes attributable to the Customer.

The calculation of the shipping costs will be made automatically during the purchase process.

For security reasons, THE COMPANY will not send any order to post office boxes or military bases, nor will it accept any order when it is not possible to identify the recipient of the order and its address.

III. Delivery Data, Undelivered Deliveries and Lost

If at the time of delivery the Customer is absent, the carrier will leave a receipt indicating how to proceed to arrange a new delivery. THE COMPANY contracts, as part of the courier delivery service, to carry out a series of follow-up actions, aimed at guaranteeing that the delivery takes place.

If after 7 working days after the departure to the delivery of the order has not been agreed delivery, the Customer should contact The COMPANY. In the event that the Customer does not do so, after 10 business days from the departure to delivery of the order it will be returned to our warehouses and the Customer will be responsible for the shipping and return costs to origin of the goods, as well as the possible associated management expenses.

If the reason why the delivery could not be made is the loss of the package, our carrier will initiate an investigation. In these cases, the response times of our carriers usually range between one and three weeks.

  1. Diligence in the delivery

The Customer must check the good condition of the package before the carrier that, on behalf of THE COMPANY, makes the delivery of the requested product, indicating on the delivery note any anomaly that could be detected on the packaging. If, after reviewing the product, the Customer detects any incident such as blow, breakage, signs of having been opened or any damage caused by the shipment, the latter undertakes to notify THE COMPANY via email within the shortest period of time. possible time, before the next 24 hours from delivery. From that moment on, incidents of this type will not be attended (only parts under warranty).

 

RETURN

  1. Return procedure

All products purchased from THE COMPANY may be returned and refunded, provided that the Customer informs THE COMPANY of his/her intention to return the purchased product(s) within a maximum period of up to 14 working days from the date of delivery and that the other conditions set out in this section are met.

THE COMPANY will only accept returns that meet the following requirements:

  • THE deadline for the communication of the return will be 14 days from when the Customer receives the order at home.
  • The returned product must be in its original condition, without having been used or damaged. Furthermore, it must be returned with all the parts and accessories that came with it.
  • The product must be returned in its original packaging and with all labels, manuals and documentation included. In the event that it cannot be returned in the original packaging in which it was delivered, the Client must return it in a protective box so that the product arrives at the COMPANY’s warehouse with the maximum possible guarantees.
  • A copy of the delivery note must be included inside the package, where the returned products and the reason for the return must also be marked.

In order to make the return process easier for the Customers and to be able to follow it correctly, THE COMPANY establishes as the only return procedure the one established by THE COMPANY. If the reason for the return is attributable to THE COMPANY (the product is defective, it is not the one you ordered, etc.), the amount of the refund will be reimbursed. If the reason is for another reason (the products were delivered correctly but are not to your liking), the cost of the return will be charged to the customer.

To proceed with a return, the following steps must be followed:

In no case may the CUSTOMER return a product on its own without having previously informed THE COMPANY.

  1. Refunds to the CUSTOMER

The return of the products will result in a refund equal to the cost of the returned products minus the cost of the return service.

Only in the event that the delivered product is defective or incorrect, THE COMPANY will also reimburse the Customer for the corresponding shipping costs.

Refunds and partial cancellations will result in partial refunds.

THE COMPANY will manage the return order, preferably under the same system that was used for the payment within a period of 5 days from the arrival confirmation to the warehouse of the returned order. The application of the refund in the Client’s account will depend on the issuing entity.

 

GUARANTEE OF THE ACQUIRED PRODUCTS

THE COMPANY acts as a distributor of manufacturers that ensure that the products presented for sale work properly and have no defects or hidden defects that could make them dangerous or unsuitable for normal use.

The guarantee will lose its validity in the event of defects or deterioration caused by external factors, accidents, in particular, electrical accidents, wear, installation and use not in accordance with the manufacturer’s instructions.
